    Its murder in the 2nd degree at least....non premeditated where the death was a distinct possibility.

    But certainly murder 1 is possible....if he could be seen to follow Bashir into the room and deliberately hit him.

              it'd be manslaughter. they'd plea it down so that he'd do very little time. i am sure his defense will be that bash had threatened a female. it sucks but any decent lawyer beats that case easily. the plea will be used because he violated parole and will be serving time anyways. they'll run it concurrent but no big deal.

                Your honor, my client feared for his life and the life of his sister so he waited until the deceased sat down and wasnt expecting it then he smashed his head in after everything had calmed down and nobody knew what was coming.

                  Wrong! It would be a Murder three because there was no intent to murder. He didn't use a weapon. He used his bare hands. He was being reckless because he put Coach Bashir's life at risk by sucker punching him in the head area while he was not looking.

                      Murder 2 is voluntary manslaughter. Which means sudden intense passion and the person committing the act formed an intent to commit murder and knows that their actions can cause death.

                      Murder 3 is involuntary Manslaughter. Which means recklessness. In other words, it's like if a driver is drunk and he gets behind the wheel anyway but accidentally strikes and kills someone.

                      He had no intent to murder but he knew his actions could put someone at risk of receiving a serious injury, great bodily harm or even death.

                      That is exactly what Clarissa Shields brother done to James Ali Bashir.
