I think classless Clarissa and the $h!t Shields family might give us our first one!

I think murder is a decent excuse to cancel a fight, don’t you?

    Wouldn't it be manslaughter technically?

nope, if you punch someone in the back of the head and they die from a brain bleed it's murder, probably murder one.

I’m not a lawyer but I think it would be murder and not manslaughter.

I think manslaughter would be an accident, like if Shields brother bumped into Basir accidentally and he hit the floor and died.

It’s not murder until it can be proved that it was pre meditated.

Yeah that's what I thought but my law knowledge is spotty at best.

            Manslaughter defined as:

"the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder."

I mean maybe it could be a murder charge but DEFINITELY not murder 1

with a good lawyer, it can be a manslaughter instead... i've seen so many dui cases where the drunk driver kills another person and they get charge with manslaughter only, you think that was an accident?

My understanding is that in a scenario where the perpetrator intended "only" bodily harm (but not death) but the victim succumbs to injuries from said assault at a later point (even months later), then the act can in fact be ruled murder and tried as such.

Your argument is 2nd degree murder vs 1st degree murder. premeditated isn't a requirement for 2nd degree murder. I'm think if you slip up behind someone and strike them in the back of the head that is premeditated. If he got angry and charged across the room, that is 2nd degree murder.

That is if he dies, god willing this argument is only academic.
