I guess the intent may not have been to murder, but the intent was to inflict great harm. I swear I've heard of cases where two drunk guys fight, one dies, and the other goes away for murder though.Comment

Yeah...hypothetically he didn’t intend to kill him, with punches. He also did not know that a few punches would kill him. He was being reckless for sure. Could be voluntary manslaughter.Comment

The issue as I see it, isn't about his intent, but rather the recklessness of his actions. To me, it's hard to argue that he intended to kill the victim. However, if a reasonable person can foresee the victim's death, then murder is warranted.
It's like the example Don Pichardo brought up in another thread. If a person drives a truck through a crowd, then it's easy for a reasonable person to foresee someone dying as a result. The issue before the court would be whether a reasonable person could foresee the victim's death as a result of the perpetrators recklessnessComment
