Normally, I would agree with you. Except, the networks and promoters would never agree to cancelling this megafight over a positive test result. After Berto-Ortiz II & Khan-Peterson II were cancelled due to positive tests, promoters got smart and made sure fights wouldn't get cancelled, so they don't lose millions. And by keeping the fight on schedule, the fighter that tested positive is indemnified by the promoters and the networks. So your litigation scenario would never happen. They won't cancel and the clean fighter is screwed into fighting a cheater.

In a interview before the Mayweather-Pacquiao was officially signed, Pacquiao did say he wanted a $5 mil penalty for a positive drug test. Obviously, that didn't happen and they are still pushing for it. So the question is....why is Floyd refusing??

I don't get what Koncz doesn't get. Floyd and Arum are saying that by signing the 5 million dollar pledge thingy, that by signing that document, If either fighter test positive, it can limit the amount either fighter would owe the other to 5 million dollars. Mayweather is guaranteed 120 million dollars. You better believe if Manny test positive and derails this fight, Floyd Is going to sue Manny for more than 5 million dollars. But if he signs this document, either side can say in court hey he signed this document limiting our liability to only 5 million. Why limit yourself? Why is this even an issue I don't understand. Make the penalty 250 million. I'm sure Floyd will sign it in a heartbeat. But 5 million? GTFOH!
