Floyd did not refuse an "extra" penalty.

He refused the $5mil penalty that would have limited any additional litigation.

I'm pretty sure that Kuntz said exactly the opposite. It would be a 5M cash payout directly to the fighter on top of the other fines/penalties because it may take years for that stuff to actually get cleared up through the courts system. Floyd didn't like that because he knows that if he failed, it would get tied up in court and he wouldn't have to worry about the ramifications until after he was retired.
