For the exact reason that it is clearly a penalty. Damages in contracts cannot be a penalty. They need to be damages. That's the view that courts all over the world have taken. You get damages for being damaged.

Additionally 37 years old is quite young now, he's younger than Arthur Bertebiev for example who is still in his prime and heavyweights age better than smaller fighters.
Usyk is at the peak of his powers and is a historically big heavyweight, this is a deadly test for Fury and he deserves credit if he wins as it would be one of the greatest wins of all time and a big upset in the eyes of many.Marchegiano likes this.
