I am in now ay trying to "negate it on a technicality". Again, at no pint did I claim it didn't happen.

I am not interested in convicting Tank in the court of NSB public opinion. I am only interested in how this plays out legally. To that end he is innocent until proven guilty.

I doubt he gets off. I am sure he will spend some time in jail or get probation.

The thing is, there he is, in reality, grabbing her by the throat, in public, for all to see. Just like the knifeman on London Bridge, stabbing people in front of everyone on film, guilty, and shot dead because of this. No judge or jury required, and nowhere in reality is he "innocent". Just like in cases where they convict the wrong man, and find him guilty. He's still innocent in reality. Because reality trumps the legal system.
