If the contract just said 170 max with no provisions for being over, I would agree with you. Jacobs didn't promise to come in at or below 170 on the second day weigh in, he promised to pay 250k per pound if he came in over 170.

Canelo's team f***ed up, they should have stated in the contract that Jacobs was not to weigh over 170 pounds or the fight was off, instead they allowed him to pay a fine for the extra weight.
The plan was always for Jacobs to come in overweight and be much stronger on fight night.
It's a bit of a gamble but if he wins/draws or loses a highly controversial decision it will be more than worth the 1 million fine he had to pay today.
