I'm pretty sure that Kuntz said exactly the opposite. It would be a 5M cash payout directly to the fighter on top of the other fines/penalties because it may take years for that stuff to actually get cleared up through the courts system. Floyd didn't like that because he knows that if he failed, it would get tied up in court and he wouldn't have to worry about the ramifications until after he was retired.

If true that the penalty would be " in addition " to the existing framework, then I dont see what the problem is.

Mayweather quickly agreed to that ridiculous $10mil per-pound weight penalty because there was 0 chance of him missing weight at welter, so I dont see the issue with a $5mil additional penalty for testing positive either.

The way I recall it, Leonard Ellerbe stated that the way the contract was worded the $5mil penalty clause effectively became the contractual penalty should either fighter test positive.

IF a fighter tests positive, the litigation will be HUGE, and nobody will be able to hide from that..... so, Mayweather is obviously not trying to cop out.

The repercussions will be immense, and $5mil will be a drop in the bucket..... so if Mayweather was looking for an " out ", then he would have accepted the dodgy wording in Koncz's clause.

Neither guy needs $5mil urgently, before court proceedings play out.

if the 5mil penalty is in addition and doesn't limit any liabilities then i dont see what the problem is. Make it so that whomever comes up dirty has to pony up $5mil within x amount of days while the legal proceedings play out.
