It's alleged because they settled rather than duke it out in court and potentially go bankrupt, both parties just accepted "fault" on the proviso that Fury wouldn't go after them for their negligence and they wouldn't remove their victories and they would apply the ban retroactively rather than from the day the hearing concluded.
