You seem very confused. The WBC ordered an interim title fight, not a diamond title fight. The WBC publicly confirmed Whyte turned it down and filed a petition to be named mandatory without ever fighting a final eliminator.

Whyte's petition was to uphold what he believed was his legal right to be named mandatory challenger without having to fight a final eliminator. He backed that petition up with the threat of legal action and the WBC compromised by sanctioning his upcoming fight with Rivas - which he had already signed for - as a final eliminator.
