That before the mortal stroke was given be had refused any further combat, and had retreated as far as he could with safety; and 2d. That he killed his adversary from necessity, to avoid his own destruction.

Here is the scenario that as I see it:

They pull gun and attempt to rob/car jack him. He pulls out or shows his gun and it NEUTRALIZES the situation. They back off.

If he didn't have it who's to say they wouldn't have shot him anyway. Look at the Billings murders.


I More than once guy pulls out a knife I pull out my knife and end of confrontation. It is no longer worth the risk for them.

I don't give chase though. I believe the legal carrying or owning a weapon in your home or person can increase safety.
