Fury was ready to fight Wilder by May 2020, Wilder wasn't, the promoters wernt and neither were the networks, but Fury was. Any combination of ppl can be to blame for the fight not happening but Fury was ready. Fury was begging and demanding to have that 3rd fight by December only to be told no.
If anybody is the victim in this Fury Wilder 3 mess its Fury. He hasn't earnt a penny from fighting since the last Wilder fight. It was Wilders side that wrote in the deadline date and it was Wilder who wasn't ready in the time frame due to surgery for his dented skull or what ever it was.
Only person ready to fulfill the contracted rematch within the contracted time was Fury. If anybody should be seeing money it's Fury.

Honestly arguing pure economic loss like this is already tricky in an actual court case, proving the damage isn't easy and establishing the actual amount is hard even when you don't have an unstable and unpredictable income as a pro boxer. And this isn't even a proper court case where you can file a counterclaim. I don't think there's any way anybody's getting money out of the arbitration one way or another.

Wilder isn't fighting anyone of note until he takes a paycut, he's a nobody without a belt and a pathetic fanbase; his only saving grace was the third fight so unless he moves back down to 7 or 6 figures he isn't getting a fight. Andy ruiz if lucky did 125k buys at 1 million dollars wilder would be lucky to do 100k with anyone.
It was widely reported the time frame of the rematch was before end of October, they didn't meet that time frame, so the rematch was not exercised.
To anyone that says well if there is a rematch clause they have to fight next without a time frame have a think about for a minute, you lose, say you will exercise the rematch but not take it for 2 or 3 years or more, no one would allow that to be permissible let alone the lawyers that deal with these contracts as their bread and butter.
It might not have been Wilder's call, from the sounds of it they lost money on the second fight and interest in the third was minimal but the fighter guarantees were still massive and without a gate it probably would have been a financial bloodbath for the promoters.
Force majeure (an unforeseen act of god) is often included within contracts, but I assume that would only cover if the fight couldn't be made because of an unforeseen issues, promoters or networks deciding they don't want to lose millions because they can't have crowds isn't force majeure, thats just a business decision.
Wilder going completely radio silent certainly doesn't help his cause in determining if he did all he could to make it happen either.

If the contract said Fury had to fight Wilder next why couldn't Wilder get an injunction stopping any fight Fury tries to make?

I don’t expect a huge payout for Wilder. He would have to show a meaningful effort to honor to make the rematch. From most reports I’ve read Wilder’s team basically ghosted Fury’s side when they tried to make the fight last fall.

In the time frame of the rematch clause Fury was willing to fight Wilder, Wilder was not willing to fight Fury. And it was a time frame that was set by Wilders side. The majority of the sports top fighters have managed to fight during the pandemic.
