We can infer some of the details of the contract. I'm sure you are right it is a question of if the time limit has expired. From what has been said and the actions that have been taken, it seems there was a rematch clause which had to be exercised for a date in the summer of 2020 (July, it seems), but which also allowed a three-month extension in the case of injury. Wilder indicated he wanted the rematch, then said he had a bicep injury. So this meant a rematch in October.
Obviously that didn't happen. Pandemic delays, TV networks not wanting it, Fury's unwillingness, Wilder's unwillingness, this doesn't really matter as to the next stage defined by the contract. The next stage, it seems, was mediation.
So they entered that. They sit down with a mediator and try and find some common ground. The only clear message I've heard reported from that is that Fury won't fight Wilder.
The options from mediation are: do nothing (i.e. both parties agree to go their merry way); settlement; or litigation/arbitration. From what Arum says, the contract specifies arbitration rather than litigation as the final step for dispute resolution.
It seems the retired judge who was acting as the mediator will make the arbitration decision and both parties would be bound to that decision.
