There's a provision in the law that says the driver must not be involved in criminal activities, so yeah he'd go down for having it on him while DUI.

Also his carry permit is pretty much 86xd also... Texas takes it real serious and doesn't like it when its abused.

Well, when I read that it was found near the scene, I was wondering how they could prove it was his. He got lucky if it was in the car and got ejected.
