    § 6301. Definitions

    (5) Manager

    The term manager means a person who receives compensation for service as an agent or representative of a boxer.
    (9) Promoter

    The term promoter; means the person primarily responsible for organizing, promoting, and producing a professional boxing match. The term ;promoter; does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match unless;

    (A) the hotel, casino, resort, or other commercial establishment is primarily responsible for organizing, promoting, and producing the match; and

    (B) there is no other person primarily responsible for organizing, promoting, and producing the match.

    ;(b) FIREWALL BETWEEN PROMOTERS AND MANAGERS-

    (1) IN GENERAL- It is unlawful for--

    (A) a promoter to have a direct or indirect financial interest in the management of a boxer; or

    (B) a manager--

    (i) to have a direct or indirect financial interest in the promotion of a boxer; or

    (ii) to be employed by or receive compensation or other benefits from a promoter, except for amounts received as consideration under the manager's contract with the boxer.

        If you are a fan what do you care if Danny Garcia makes 2mil for a joke fight against a non ranked lightweight? What you should care about is that the fights you want to see won't get made because Haymon is either protecting his fighter or refusing to work with other promoters.

        People said the Haymon mismatch BS was just a neccesarry evil until he created PBC. His supporters said just wait you will see real fights once PBC launches. Well look at the crap you are seeing on PBC. Look at the next bum Wilder is fighting on PBC. Look at the crap fight Khan has, look at the crap fight with Broner ect. Again why should I or any boxing fan give two craps that Haymon is overpaying his fighters for these lousy fights? Tell me how this is good for Boxing? The lawsuit is about Haymon stealing food off other people's table but in the process he is creating a bad product and ruining boxing. If he were just a crook stealing money from rival promoters I wouldn't care. But he puts out a terrible product and prevents the fights fans want. That's why I'm supporting this lawsuit because getting the Haymon cancer out of boxing is good for boxing fans.
        the fighters can refuse the fights and say no get me harder competition they don't really care about fighting the best and that goes for all these fighters and promoters duva arum Hearn all make **** fights they try and make haymon seem like this devil just look at how arum kept talking trash whole time about haymon before Floyd and manny fought you would think he wouldn't wanna do business with him again right nope they are willing to do rematch its all smoke and mirrors because haymon stays behind scenes and let's the fighters get the glory doesn't take away from they shine haymon doesn't talk to media or defend himself he obviously don't care what people think of him all his fighters are happy with job he doing with they careers or else they would go sign with a promoter someone name a fight haymon stopping from getting signed

            That's the problem the fighters aren't in control Haymon is. Stop playing dumb you know damn well Haymon tells them who, where and when they fights. And it will only be worse if PBC were it's own league

              Do you see haymon in ring with fighters like these other promoters are after fights or running to media acting like fools making themselves look silly case in point duva and arum now pacman whole image is ruined because arum can't keep his mouth shut to media duva making Krusher look like he the one ducking Stevenson now because she can't keep her mouth shut Hearn with this frampton quigg rigo fiasco going on now they all should take notes from haymon and work in the shadows let the fighters do the talking

                And again if fighters feel some type of way about it they can always drop haymon like dirrell did and get someone else even though dirrell came back fighters don't want to sign them slave contracts to promoters now with them built in extensions after extensions and if you don't sign a fight that has a extension on top of it you sitting on the shelf having to waste time in court to try and get out mikey Garcia still going through it with arum now ward was on shelf fighting in court for so long Chavez was until haymon just bought contract out promoters see boxers as ****** ownership they have more control with no promoter to make they own choices if they wanna be signed to a promoter and still use haymon as a manager they can

                  Threads like this really expose how many ****** people post on the Internet. I am actually stunned that there are so many posters here who are simply incapable of comprehending the facts of this discussion or the lawsuit. Is the US school system really that poor or did a lot of people here go through school on athletic scholarships? I just can't figure it out. I always assumed that being able to operate a computer and register and post on a message board required a certain level of intelligence but I am surprised some people here can even tie their shoes without help or supervision.

                      Looking at the definition of "promoter" in the Ali Act, it will be very difficult for Haymon to prove that he is not a promoter ("the person primarily responsible for organizing, promoting, and producing a professional boxing match"). It is immaterial that he does not have a license or hires someone else who does, as long as he (or his company) is primarily responsible for organizing the events. That SBJ article will come back to bite him.

                      The hard part, though, is Oscar doesn't have standing to sue under the Ali Act. That's why he's folding this into an anti-trust case. Federal anti-trust cases are extremely difficult to make stick. It is particularly difficult to prove an anti-trust case against a single entity. It was brilliant to say that Haymon already has a monopoly over the management of championship-level fighters that he's using to create a monopoly over the promotion of championship-level fighters. There's already SCOTUS precedent establishing that there is a distinct market for championship fights and it's somewhat easier to prove a monopoly where vertical integration is alleged.

                      Oscar's best claim is buried at the end. California has unfair competition laws that allow a company to sue its competitor for engaging in unfair competition, which includes breaking any federal and/or state statute. The Ali Act would qualify. This isn't the lead complaint because Oscar would not be entitled to damages under the UCL; he could only get an injunction or restitution. An injunction that prevents Haymon from acting as a promoter and a manger would destroy the PBC. The worst outcome for Haymon is that the judge grants a preliminary injunction, meaning the judge decides before the trial that Haymon is more likely than not to lose on the merits and allowing him to continue breaking the law would cause irreparable harm. That letter from the Association of Boxing Commissions to the Attorney General asking for an investigation into Haymon will really hurt Haymon there. An independent quasi-governmental body making the same allegations will carry more weight than when they are made by a competitor.

                      The real battle will be over the preliminary injunction, which will happen sooner rather than later. If the judge enjoins Al from operating as a promoter and manager, the PBC might not be able to operate at all until the lawsuit is over.
