He's been explained this, hell he explained this when he made the statement but with all the click baiting going on over this fight it took NSB a week to actually give the facts but only because that story had died down and the man did another interview. I'll be a million points we see 7 articles about this one interview over the course of this coming week.

Ellerbe is the one spinning this thing. The 5 million would be on top of whatever they could get fined by the commission and by violating the fighter contract. Arum was saying its not necessary which hes right, but why not just agree if mayweather has nothing to worry about? Kontz is absolutely right it is very su****ious and I am glad he is calling out mayweather who just so happens to be working with angel heredoa who notoriously helped many Olympic athletes including marion Jones cheat usada drug tests and win gold medals. Now hes helping guys like Marquez and Floyd mayweather juice to be able to beat Manny. That is the only hope mayweather has at this point is if hes juicing and can knock Manny out. Otherwise its hasta luego for mayweather fabricated career

The Additional $5 Million Penalty Makes Perfect Sense
... And it does NOT replace what's been agreed upon, but simply ADDS monetary compensation to the fighter who's clean.
The question is: Why won't Floyd Mayweather Jr agree to it?
Given his position on the matter, and his financial capacity, it really IS surprising he will not agree to this additional penalty clause/stipulation. It doesn't necessarily make you wonder why, but it's puzzling nonetheless.

it could have said 5 mil max meaning they only paying 5 mil, but thats over ya head, and Floyds the idiot to all u ppl lmfao.
"We didnt want to jeopardize the fight by talking about it during the negotiations", but well make a HUGE deal about it now after Mannys been juicing under Justin Fortune,
sounds to me like Koncz is saying, we juiced and still are, let me "sneak" this into the contract so Manny only pays 5 mil
and how u know neway, hell manny dont know lol but u "get" where koncz is coming from lol, and u talk about Heredia and Ariza when Fortunes a known PED user.........hypocrisy

This guy really is an idiot, and the worse thing is his stance makes not only him but Pac look like a ******, this is why Arum himself came out and shut this down before he makes Arum look like an idiot too. The thing is he is actually making it look like he wants a limit on how much each fighter has to pay if they test dirty.... Why would you want to limit that unless you are dirty?
