Your were arrested in the bronx not for selling drugs there but for buying drugs in manhattan meaning that your case was a manhattan one. That's why you were taken to the city tombs. They were building a case on who you got your stuff from and not from your own blocks doings. They may have tacked on charges for what you were doing on your block but the case originate in the city. Guerrero hadn't committed a crime they were aware of until he exposed a law violation to them within an airport. You can't prosecute him for every block he walked down or rode past in a car. In his case the crime became evident within an airport so it's different in that sense.

He was coming from out of town with another wise legal registered weapon and following procedures checking it at the airport... It gets into your intent in the sense that if someone placed the gun on him without his knowledge he wouldn't be guilty of an offence. I think the more appropriate word to use is purpose. In this situation Guerrero purpose ( transporting it from A to B) should only act as a mitigating factor.Did you not read what the article said? The law was changed moving the unloaded gun from a misdemeanor to an E class felony. Criminal law doesn't get into your intent when it comes to breaking a law...you did or you didn't in this regard. So whether it makes sense or not a gun with no ammo is still breaking the law in NYComment

That gun is not registered in New York and likewise he wouldn't catch a break in California...it's called states sovereignty...the rules and regulations of one state have no bearing on how another one administers their laws.
