German law differs from Anglo-American law in employing a more lenient proportionality requirement: the response is unjustifiable only if it is grossly disproportionate to the threat. See T. Markus Funk, Justifying Justifications, 19 Oxford J. Legal Stud. 637,638–42 (1999); Heribert Schumann, Criminal Law, in Introduction to German Law 396 (M. Reimann & J. Zekoll eds., 2d ed. 2005). It is unclear whether German law requires an
actor’s beliefs about the elements of self-defense to be both honest and reasonable. Id. According to Fletcher, “[t]he German code contains no legislated solution to the problem. ”George P. Fletcher, Basic Concepts of Criminal Law 159 (1998)

slip the punch and throw a counter? that has never happened in the history of boxing in any press conference you clown. i could come up with 100 different post/pre fight-brawls and you'll never see somebody just duck that first punch that came out of nowhere. youre obviously just a haye hater. and no, the cops arent looking for haye
also tell me why wasnt chisora able to duck that first punch. or the second punch. or the third punch. why wasnt klitschko able to slip that slap he got. you're delusional man. have you ever been in the ring and fought somebody?
just off the top of my head, morales takes the sting outta the shot and comes straight back.
Dereck Chisora "wholeheartedly apologises" for his part in a brawl with fellow Brit David Haye in Munich.
Haye was not at his hotel on Sunday morning and failed to turn up for his scheduled flight, with police still eager to talk to him about his involvement in the brawl.
It is understood officers went to Haye's hotel in the early hours of Sunday morning and were knocking on doors and questioning guests in a bid to find the former world heavyweight champion.
According to Press Association Sport, it is thought Haye could already be back in Britain having possibly fled in the immediate aftermath of the incident.
"David Haye is not in his hotel, he is not at the airport. We don't know where he is," police spokesman Gottfried Schlicht told Sky Sports News.
"We want to speak to him about what happened on Saturday night. We have to hear both sides of the story."
that's because most people can't fight, you look at those videos all over youtube and they're jokers, absolutely useless.
whenever i've had a fight in the street, particularly in front of cameras in the town centre, i've said "if you want to go on then". if they don't then cool nothing happens, otherwise as soon as i see them make that move, i'll drop my right foot back a tiny bit and launch a arrow straight right hand, which is 99% of the time going to be quicker than the looping shot that is likely to come at me and straight into the middle of the face. works a treat and to the letter of the law is self-defence. so **** you. if i can do that i imagine a former heavyweight champion shouldn't need to worry so much that he has to use weapons to pre-emp an attack. haye was evidently ready and waiting to kick off, that gives a big advantage to the old reactions. chisora didn't expect that, vitali didn't expect the slap etc etc.
and yes i box myself and i coach others to box.Comment

Fair enough, mate.I'm doing a law degree right now, mind you.
Again you are wrong, the level of force used does not have to be equal it has to be reasonable. So if someone punches you and the only way of defending yourself is to stab them, that would not be unlawful the same would apply with your knife-gun example.
It's up to the jury to decide whether or not the force used was unreasonable. In this situation David was attacked by a 243lb man and his entourage, throwing punches and even swinging the tripod can be construed as reasonable force depending on how he perceived the threat at the time. If he speaks to any sensible lawyer they will say in ''In the heat of the moment my client did not know who was friend or foe, he genuinely feared for his life/safety''.
I didn't study law to the level you have by doing a Degree and it was a long time ago so in all honesty it's probably changed.
At the end of the day, let's just hope in regards to Haye he gets his license and in regards to Chisora, he keeps it.
Then they can settle it in the ring.Comment

It was either get slapped by Chisora like Vitali and be around the web as the guy who got slapped. Or hit him first and come out looking like the "trouble maker".
I say it was Chisora and his manager who started it all. They verbally attacked Haye, then Chisora provoked Haye to say it to his face(that he's a loser), and walked up to Haye who was an onlooker all the way in the back of the room.
Haye did nothing wrong here, if he wouldn't have hit Chisora, Chisora woulda hit him and people woulda just made fun of Haye.Comment

LOL Chisora wasn't the mandatory, you can't be a mandatory after officially losing a fight. Vitali said he chose to defend his title against Chisora because he believed Chisora really beat Helenius. I'll ask again, is he an idiot for believing that?hehehe you dont like pac fans....you brought that up in a conversation that has nothing to do with the topic at hand....and im the dumbmother****a here...lol also because im a fan of a certain particular fighter ,i dont understand things....? I've had dudes try that with me but I'm quick enough to dodge the first punch and retaliate tenfold. Most people can't fight and you can see their **** coming from a mile away.Originally posted by billvpyeah that works if you are dealing with blowhards who aren't going to hit you
What about when I walk up to you, and you stand there trying hard not to flinch and then I ****ing knock your ass out?
First rule in a street fight is to get the first punch in.Comment
