Its a WBC contractual obligation, the Texas Athletic commission doesnt require testing, so theres no way it can get overturned to a NC.

I don't know if the decision can be changed to a NC, but I think Rubio may be able to successfully sue Top Rank for breaking their contract. He could at least get cashout paycheck from this seeing how his career at the higher level is pretty much done.
