DAZN are in a bad position.
They stated they would go Global in Q4 2020 all during a pandemic. If they were uncertain of this, they wouldn’t disclose it. The acknowledgement regardless was no attendance fights. When you plan to launch globally you have to have capital to do that. Therefore, how does DAZN convince a court that new global buys wouldn’t alleviate any minor costs for Canelo’s Q4 fight? Canelo was their commodity investment for boxing, that’s the risk in pushing the brand.
What’s worse is that if Canelo agreed to a cut, it shows that Canelo was empathetic from the get go. That will suit Canelo in court, and the longer it lingers in staying ready benefits Canelo because boxers have an average quota for 2 appearances a year. That’s the context of a boxer in professional sports.
That fact that it’s OTT, DAZN is going to have a hard time convincing a court that Canelo’s initial package was never intended for playback archive. DAZN would own the rights to all Canelo’s fights under DAZN. Those are worth as years come. It’s simple business.
There are forces, in my opinion, like Eddie Hearn whom will be exposed as persuading DAZN regarding “Premier” opponent refusal. Where DAZN get the consulting for “Premier” World Class? The investments are belts. DAZN is making it more complicated.
