Mortality rate is nothing to do with being a pandemic.

Being a pandemic is about how widely an infectious disease spreads. Given this has spread around the world with vast numbers of infections in every major country, I think it's classification as a pandemic is safe.

Well, it's certainly a pandemic given the fact that it spread across the world and is now endemic in the populations of most countries; however, you're entirely right about it never being as dangerous a pandemic as it has been advertised.
