Contract law is to be taken seriously
A lot of the convos on here about the GGG payment aren't super well informed about the relevant law, so I thought maybe we could make it a little clearer.
The fact that Cotto doesn't want to pay GGG, after having agreed to do so, is understandable. After all, he had achieved what he wanted - to avoid GGG and set up the lucrative Canelo title fight. But Cotto is a boxer not a lawyer and he is just digging himself into a deep hole here.
IF he agreed a deal with GGG, even if it wasn't written down (there are aural contracts) then that is a contract.
I'm not allowed to post a URL to a legal authority yet so you will have to google it yourself I'm afraid - try "law what is a contract"
"Definition
An agreement creating obligations enforceable by law. The basic elements of a contract are mutual assent, consideration, capacity, and legality. In some states, the element of consideration can be satisfied by a valid substitute."
SO
a) there was mutual assent - even Cotto has declared that publicly on several occasions
b) there was consideration - ie money
c) there was capacity - both parties could deliver under their obligations. GGG stepped aside as agreed. Cotto could pay him.
d) the contract was legal - there is nothing about the terms that are illegal.
Hence we can say that this agreement constituted a contract. Cotto appears to be saying that he won't pay. Hence he isn't proposing to satisfy the contract as agreed or by substituting a valid substitute.
Contracts are enforceable or remedies may be obtained.
"Possible remedies for breach of contract include general damages, consequential damages, reliance damages, and specific performance."
This is no joke. If GGG's team decide to take Cotto to court then he will be sued for more than the $800K. They will claim consequential damages etc. This case is very unlikely to reach court. It will be settled but if K2 decide to play hardball it will be for more than $800k.
Roc Nation have lawyers and they know all this just fine. I very much doubt they think they won't end up paying GGG. Personally I suspect this is all just part of the Cotto smokescreen to wriggle out of the possibility of him looking like he's running from GGG.Comment

I remember being a little kid my grandpa used to tell me: "You see them guys in suits, NEVER NEVER NEVER trust a guy w/ a suit. You know why?, cause they never get to buy their suits with their own money, they will steal your $$$ to buy them." Man, I took it to heart and boy he was right!
I'm with Cotto 100%. I always enjoyed it when FMM stick it to the organizations.
True, Cotto benefits from skipping his mandatory in GGG. He's fighting a fighter that suits better his style for a lot more $$$, but the WBC, GBP and HBO ALSO benefits from this. What's Cotto saying is, if now we have a bigger pie and all you mfs are getting more pie, why the F*** am I the only one paying for the ****ing pie?
But ppl here is all about the hate, nationality and riding D's for x or y fighter!!!
I'll always support the fighter, at the en of the day, he will be the one stepping in that ring putting his health at risk!!!Last edited by The Collector; 11-19-2015, 03:14 PM.Comment

I just told you the interim rules of a governing body. It wasn't a garbage opinion. Stop beating around the bush already. GGG wasn't even supposed to fight for an interim belt from the get go & none of this woulda been happening.

Rubio was asked, and compensated, to step aside to let Cotto fight Martinez. He agreed and was paid. Golovkin gave permission and was going to be compensated, or is pending a compensation, for stepping aside. Tom Loefler said Cotto approached them to get permission to fight Canelo, which they agreed to.
Rubio compensated:
The show will go on between middleweights Gennady Golovkin and Marco Antonio Rubio, as both sides agreed to terms for a modified weight limit following Friday’s follies at the scales. Rubio stripped all the way down to his bare essentials but still tipped the scales at a beefy 161.8 lb, nearly two pounds over the allowed 160 lb. limit for Saturday’s title fight at StubHub Center in Carson, California. The veteran was granted two hours to sweat off the additional weight, but opted to come in at present form rather than further weaken himself, a safe assumption that he didn’t believe he could effectively make weight.Comment

The wbc finally rated the number one guy correctly. You should be pointing your finger at the multiple errors Cotto has made. Instead all of you want to blame someone else for this fiasco when the real culprit is in front of you. But you all hate ggg so you have to blame an organization who violated its own ****** rule and finally did the right thing. Makes sense. Only on here.Comment

yes it would. Just not for a title.
