So Pac said "let's have a $5m penality if anyone gets caught cheating" and Ellerbe said "no, let's make it higher than that to be sure"
What seems to be the problem? Why are you fanboys crying about it? Seems fine to me so that there won't be any questions regarding PED-usage, plus whoever cheats gets embarrassed and loses money. Both sides are in agreement to there having a penalty for cheating.

You think he should be able to sue for the other "potential" 90 million dollars that he wouldn't have gotten anyways? Same thing goes for Pac's side of it too. That's my point, you can try to sue for whatever you want but any potential earnings are hypothetical and mere estimates, the guarantee is the only thing set in stone.
It's up to the lawyers making the case; tickets at the venue, priced $1500-$7500, were all basically old out before the contracts were signed, the UK tv rights are basically going to start the bidding at 10-15 million pounds, and Televisa/Azteca are joining forces to both air the fight in Mexico. The US PPV is likely to be priced $89/$99, and the general fan/press interest had the fight marked to shatter the prior PPV record.
The lawyers can start with whatever the guarantees in the actual contract were, but they can use all sorts of fight-related info to build the case for requesting a larger settlement than outlined as the formal guarantee

I just don't see Pac's team trying to come across with some offer of a 5 mill cap if there was an agreement stating the terms and consequences of drug testing already signed. That makes no sense at all. Both sides already knew what the deal was if this was the case and the additional document didn't even need to be drafted to begin with. Sounds like it has been tossed back and forth for a while now......I remember reading articles about it almost a month ago so it's not like this was something just proposed this week.
It was something that was being entertained by both parties but has just changed yesterday or today for some reason. Now it is being presented like Pac and his team tried to sneak in some last minute deal to cap off the PED penalty......this is not the case.
