The problem with this is the contract is dependent on HBO buying the fonfara fight. If all of that was part of the agreement, HBO passing on that fight basically breaks the agreement or at least creates a counter offer. Either way u look at it, it wasn't Stevenson who broke the agreement in this case.

1) Main Events/Gym/HBO reach a verbal agreement documented in emails that HBO will air Stevenson-Fonfara then Stevenson- Kovalev
2) Gym/Haymon run to Showtime and get a bigger offer for Stevenson-Fonfara and ask HBO to match it without assurances that they'll fight Kovalev afterwards.

- Aa irreparable prejudice
- The enforcement of the injunction would do more harm than not enforcing it
- The urgency of the situation.
In this case:
1- An injunction preventing Stevenson to fight until the situation is resolved would be more damaging than the absence of injunction would be for Kovalev.
2- There isn't an irreparable prejudice in this case. Worst case scenario, Stevenson would have to pay Kovalev.
Sorry if some of it doesn't make sense, English isn't my first language, especially for legal matters! And maybe it isn't 100% accurate, depending in what country/state the injunction is filed.Comment

Dan Rafael said that HBO had the right to match Showtime's offer. Which seems to imply that there was a legal opening there for Stevenson to do what he did.
Maybe that just applies to the Fonfara bout though. Who knows.Comment

I don't think so remember after HBO failed to match the Fonfara offer and Stevenson was being criticized for what appeard to be step 1 in ducking Kovalev his people came out and said that didn't rule out the possibility of him still fighting Sergei which makes it sound like that deal wasn't contingent upon the Fonfara fight being aired on HBO.Comment

What's wrong with that is it's clearly been stated that Showtime would get the right of first refusal now that HBO passed on the Fonfara fight and Showtime picked it up. So yea, one fight was contingent on the other. That much is immediately clear from just about everything we know.

That doesnt violate a previous agreement. In fact all that does is imply there was never any binding agreement. Instead there was more of an option contract in place. By changing the terms the agreement vwasbt violated, it basically constituted a counter offer. Which is valid in itself. The counteroffer was just rejected by HBO. The main thing to note here is HBO is not contesting this. So I think they understand what happened here is valid within itself.Comment

I don't know where this "two months" comes from, other than Dan Rafael. It was less than a month:
On Jan. 23, Kovalev promoter Kathy Duva of Main Events and Stevenson promoter Yvon Michel of GYM agreed via email to the terms and the revenue splits between them.
The next day, the two got on the telephone with Peter Nelson, the director of programming for HBO Sports, and the threesome agreed on the financial aspects of a deal. It would include Kovalev facing Cedric Agnew, a bout that will be held on HBO in Atlantic City on Saturday, and Stevenson meeting Andrzej Fonfara on May 24, with Stevenson and Kovalev then meeting in the fall.
Not long afterward, Stevenson officially hired Al Haymon Feb 19th.

Once Haymon was hired that's when everything changed. We all speculated this would happen the moment Haymon was hired. We all said "watch, this means no Kovalev" and sure enough here we are, no Kovalev vs Adonis.Comment

Kathy Duva has more heart than a man named Adonis who also calls himself Superman - imagine that. Would be great if she got this KO. The more that comes out, the worse Adonis and his team looks.Comment
