but back to the main point, the two sides claim something different. what arum claims is that the contract was tolling because of donaire's injuries in the first year of the contract. which makes sense depending on the jurisdiction.
what donaire's side is claiming is that the contract is void(big difference from voidable) because arum did not perform, his required performance being the deliverance of 3 fights yearly. now if this is the case, and this is in the contract, the contract is indeed void. which means it doesnt exist. this is very different from voidable, because if it is merely voidable, it would be up to a court to make the determination. but if it is void, then gbp has every right to make their own contract with him without fear of interference. imo, if what both sides said is indeed true, then the contract does appear to be void. the only way i see a court saying otherwise is if knowing that arum did not perform, donaire went along with the deal anyways. once again, depending on thei jurisdiction, this may be enough for the court to use his actions as an agreement to the creation of a new contract, whatever that might be. and once again, im taking this as if what both sides said is true.

hahaha no, you're not. because the first thing you would have mentioned is that arum would have to get an injunctive hearing (like king did with mayroga to stop him from fighting under the contract of another organization) before he could do ANYTHING to stop nonito from fighting.
you DONT KNOW THE FACTS, therefor, you can't try to apply the rules of civil procedure, or contract law to the case! we need to know the circumstances.

actually u guys r right - this is BS and u should be able to comment on anything having to do with boxing. and dempsey you prolly r a 3L - seem to have succinct understanding of what you have posted. . . sorry im just frustrated right now from ****ing reading these goddamn cases for civ. pro II. . . it's all in fun anyway, just speculation. carry on guys. haha seriously i was being a doosh. u guys will soon realize i admit when im wrong all the time.
