Defamation is one of the hardest cases to prove, Pacquiao's lawyer will have to prove that GBP spread knowingly false information about Pacquiao with malicious intent. How can you prove that they knew Pacquiao wasn't/isn't on steroids was false information? How can you prove they did it with malicious intent?
This isn't Judge Judy b.
GBP's lawsuit is worth 10 of Pacquiao's defamation suit, and probably even more so than that because Pacquiao's is worth -0 because he's just spending lawyer fees and won't recoup.
Good luck to Top Rank suing GBP for exclusive promotional rights, even though Pacquiao signed 2 contracts an there's an agreement in place, based on defamation...
On topic: Arum and co. just cannot stop being greedy POS. This is more than likely the reason why they haven't worked together for months.
and now add that theres video clips of floydie's racist tirade of pac all over the internet, as well as the mayweathers continuously defaming pac on you tube videos, etc...it think all of this video information (on charactor and integrity -- the mayweathers have no integrity PERIOD!!!) will come into play as to whether or not team pac/top rank/arum wins the case against GBP/delahoya/the mayweather sc.umsLast edited by indystress; 09-22-2010, 12:01 AM.

The Judge striking down their motion twice and allowing Pac's attorney to take depositions and do a legal investigation... meaning it will go to trial. Obviously the district courts of Nevada and GBP themselves disagree that this is a 'baby doo doo' case.
Have you ever had an appointment in court?
Because you take none of this into consideration while asking yourself why GBP would want the case dismissed. The courts not dismissing it, just means that there's enough evidence to take it to court, not that there's enough evidence to prove the case is winnable.
All they have is media quotes, but how will they prove that GBP knew Pacquiao wasn't/isn't on steroids was false information? How can you prove they did it with malicious intent?
They won't be able to, unless Hoya, Schaefer or one of the higher ups in Golden Boy admits that they knew he wasn't on anything, either that or if witnesses can convince a jury that they know that Hoya and co. knew he wasn't on anything and maliciously spread the false info.

Its sickening that Golden Boy still receives percentage from Pacquiao's hard earned fights when they continuously discredit and defamed him. I throw up to GBP.

So you've come to the conclusion that since GBP is a multi-million dollar corporation, they don't care about wasting money on unnecessary lawyer fees? Rates raise depending on the status of the lawyer. Lawyer fees can quickly go through the roof with a lawyer the level and profile of Bernstein.
If the judge dismissed the GBP's motion and called for depositions... TWICE... that means he feels Pacquiao has a winnable case, otherwise he would've dismissed it. Does not get any simpler than that.
The courts not dismissing it, just means that there's enough evidence to take it to court, not that there's enough evidence to prove the case is winnable.
Never mind the multitude of statements made to the general media, including DLH comparing Pac's punches to those of Mosley and Vargas (two admitted/known PED abusers)- In the deposition, Schaefer released a 3-page statement on why he and the Mayweathers suspected Pac was on PEDs, he mentioned head size... in an attempt to show Pac is on roids... while under oath... he was making accusations. Also, Ronnie Nathanielsz claims Schaefer insinuated Pac was on PEDs during a meeting they had last year.
All they have is media quotes, but how will they prove that GBP knew Pacquiao wasn't/isn't on steroids was false information? How can you prove they did it with malicious intent? Tell Ronnie to get on the stand and convince a jury that not only did Schaefer insinuate Pacwas on PEDs, but he knew it was a false accusation that he was maliciously spreading.
Pac's lawyers won't have any issues showing the statements were malicious and part of a larger conspiracy to tarnish Pac's name/legacy/brand. Schaefer shot himself in the foot in court, and so did DLH reportedly. Both guys can see the writing on the wall and they're trying to rake in one more big payday from Pac or have bargaining chips so they can force arbitration.
Lol at the bolded, just lulz. There is no exchange, GBP's lawsuit is worth at least 100s of thousands more than Pacquiao's defamation suit because Pacquiao's is worth -0 because he's just spending lawyer fees and won't recoup. They won't be able to prove a thing beyond the statements, unless Hoya, Schaefer or one of the higher ups in Golden Boy admits that they knew he wasn't on anything, either that or if witnesses can convince a jury that they know that Hoya and co. knew he wasn't on anything and maliciously spread the false info.
