Funny that Manny's lawsuit against Schaefer and DLH is for $5 million. This is more or less a counter-suit, which will be counter-suited by TR when they push for sole promotional rights to Pac's career since GBP did not act in their partial client's best interest and potentially hurt him financially and damaged his reputation with their baseless PED accusations.

In the end, this whole issue will probably go to mediation and be settled out of court- something along the lines of both sides drop their lawsuit (but Manny still pursues the Mayweathers in court) and GBP's promotional stake in Pac ends. But if GBP goes forward with both cases in court, look for TR to at least get GBP out of the Manny sweepstakes and Schaefer/DLH to cough up $5 mil to Manny.

I am not a lawyer but sure it won' go down like that. Manny signing
to two different promotional companies just shows how wrong he was.

Schaefer and DLH tried TWICE to get the 'baby doo doo' lawsuit dismissed and TWICE a judge denied their motion and allowed Pac's lawyer to take depositions from both, meaning their testimony will be used against them in a TRIAL. They tried several times unsuccessfully to avoid the doo doo, but they can't. It's real and they will have to pay. So this is their response. They don't have legal access to Top Rank's accounting books, so how could they know what Arum and Co spends on promotions?

It's a ploy to counteract the defamation suit and nothing more.

Yes! Because that was the deal after Manny Pacquiao made a bad
mistake and decision by signing with two promotional companies.
Legally, Golden Boy has a claim on some of Pac's $.

You sound as if you're making a good point, but if you've even partially heard Pacquiao's defamation suit, and you assume he will win, then I am tempted to say that you don't know ****. Here's further explanation on why I say that.

Defamation is one of the hardest cases to prove, Pacquiao's lawyer will have to prove that GBP spread knowingly false information about Pacquiao with malicious intent. How can you prove that they knew Pacquiao wasn't/isn't on steroids was false information? How can you prove they did it with malicious intent?

GBP's lawsuit is worth 10 of Pacquiao's defamation suit, and probably even more so than that because Pacquiao's is worth -0 because he's just spending lawyer fees and won't recoup.

Good luck to Top Rank suing GBP for exclusive promotional rights, even though Pacquiao signed 2 contracts an there's an agreement in place, based on defamation...

It is $3-5 million...let's say $4 mill. This really shows that if Golden Balls actually are owed this money (and you can be sure that they have also charged INTEREST, acruing compounded) the capital amount was originally much less.

AND ...the piece de resistance, is that $4 mill-INCLUDING years of interest-is a paltry amount considering how much TOP RANK made from the several fights, and SHOWS CONCLUSIVELY that Golden Balls has only a TINY percentage of MannyP'. (Maybe 3%)

CHICAGO – While Manny Pacquiao was busy campaigning for a congressional seat in the Philippines, Judge Larry R. Hicks of the United States District Court of Nevada in Las Vegas denied two motions filed by Oscar De La Hoya and assistant Richard Schaefer.

De La Hoya and Schaeffer filed an Anti Strategic Lawsuit Against Public Participation (SLAPP) motion and motion to dismiss the $5-million defamation suit Pacquiao filed against them.

At the same time, Judge Hicks granted Pacquiao’s ex-parte motion to conduct “limited discovery and modified briefing schedule" for defendants De La Hoya (Golden Boy Promotions owner) and Schaefer (Golden Boy’s chief executive officer).

This means that Pacquiao’s lawyers, led by David Marroso, can now take depositions from De La Hoya and Schaefer on the issue of the Filipino boxing icon’s alleged use of performance enhancing drugs (PEDs); any statements or communications made by the defendants, their agents or representatives in connection with that issue, including defendants’ mental state; the circumstances and basis upon which any statements were made, and knowledge of any statement’s falsity.

Pacquiao will need the depositions to oppose De La Hoya and Schaefer’s motion to dismiss and the “Anti-SLAPP" motion, a special motion filed in Nevada by a defendant to dismiss the case within 60 days after service of the complaint.

The order also said that “Pacquiao may not seek information or documents relating to De La Hoya’s or any other boxers, use of performance enhancing drugs."

This thing is going to trial and GBP tried to stop it twice. Twice they failed. If it was such a blase case, they wouldn't go through so much trouble to try to get it dismissed. Obviously they feel there's a real chance they may have to fork over $5 mil to Pacquiao. The Judge striking down their motion twice and allowing Pac's attorney to take depositions and do a legal investigation... meaning it will go to trial. Obviously the district courts of Nevada and GBP themselves disagree that this is a 'baby doo doo' case.
