They're technically two different situations.

While it's an odd situation... you can still be in contract for one thing... but sue for another...

Leverage! Obviously it puts the heat on Floyd to take the fight because in my opinion if the fight happens the lawsuit gets dropped and if it doesn't lawsuit will continue.
