I would say good luck to trying to win a defimation case because these cases are some of the most difficult to actually win. The United States strongly protects 'Freedom of Speech' and it is hard to argue that someone's opinion is actually defimation. Also a defamatory statement must be a false writing or visual representation that exposes someone to contempt or hatred. Slanderous defamatory statements are false statements that are orally communicated. Here in lies the problem, everyone is entitled to their opion thus 'Freedom of Speech'. So far the only person who has verbally stated that they think MP is on steroids is Floyd Sr.. Notice that in FMJ's, Ellerbe's, and ODLH's statements they were careful not to say or imply that he (MP) is using steroids.
Another issue is that MP's refusal to adhere to the drug-test could imply guilt and leaves rooms for doubt. This is an argument that Mayweather/GBPs camp could certainly argue.
Also, for a defimation case to be won or defeated the 'truth' is crucial. The only person that MP really has a case against is Floyd Sr.. While FMJ's request for additional testing is unusual, the NSAC approved the additional 'Olympic style testing'; additionally irregardless of the USADA testing both fighters would still have to go through drug testing.
Lastly, Alex Ariza has went on record saying that " Manny Pacquiao does not know what I give him" (in reference to nutrients/supplements). The Mayweather side could certainly argue that how can MP be so sure if his trainer has said that MP has no knowledge of what he takes.
By the way, I do NOT believe MP is using any PED's and I do not think FMJ's request for additional testing is unreasonable. In the end good luck with trying to win the lawsuit because it could prove to be an uphill battle.
