If Floyd is asking for USADA in his suit and the judge rules it, Manny will have to do it no matter how many times he's passed NSAC. So in the end if Manny still has to go though these tests and wins, what does he really gain from this? They both will have to pay hefty legal fees while this case is tied up.

You wanna accuse someone they're doing something wrong then it's up to you to prove it. Defendant doesnt have to do jack. It's innocent until proven guilty.
