shrewd move by canelo’s team. they originally filed in federal but didn’t have the needed info. now they do and somehow got dazn to request a return to federal.
Yeah I think you're right. I wasn't making proper sense of it at first. I thought Canelo was trying to get DAZN back down to state level but in fact he's trying to get the GBP claim back up to federal and get it heard by the originally assigned judge (Anderson).

Canelo initially filed in federal court, then refiled in state court at the end of last month after Anderson dismisssed on the grounds of diversity jurisdiction. The case was then supposed to be tried by Judge Linfield

The case will now be presided by the Honorable Michael P. Linfield, who was first appointed to the Superior Court in 2003.

Then a coupla days ago DAZN fliled to have their case handled in Federal Court and were assigned a new Judge (Olugin) and now Canelo has filed to have the GBP case also heard at Federal level but have both cases heard by Anderson instead of Olugin... which would kinda bring it right back to where it started.

You think Canelo's lawyers got DAZNs lawyers to request the federal level hearing? You reckon perhaps they both see a common interest there? Worth bearing in mind that GBP is LA based so might be considered to have the advantage having it heard at State level.

Who cares.. no one here are legal experts.. Canelo can keep training to fight no one.. meanwhile, GBP business goes on as usual.

Canelo and his team want this case in front of a jury. They know they aren’t likely to rule against him.
DAZN wants this in federal court so they can drag it out and try and force Canelo to cave.
I don’t see any way this goes to federal court. This is in essence a contract dispute which almost always is treated as a civil matter.
DAZN knows their arguments won’t play well in front of any jury, much less a California jury that will be more sympathetic to Canelo.

seems canelo’s team is a couple steps ahead. they didn’t have the info needed to make the original filing in federal stick. by forcing dazn’s hand (re-filing via state), they were able to get them to file for federal while giving up the info needed to keep it there. last thing dazn wants is a state trial and it wouldnt even make sense given the background of the three parties. if canelo filed there originally, it could have gotten thrown out with no recourse. clever move.

it isn’t a common interest thing. well it is but one guy wants it while the other has no choice (dazn). i dont think canelo gets the money he’s asking for. but i do think he’ll get a release within a year or, at the very least, an injunction to fight while the case is ongoing. he has a strong argument for that as he’s already been out the ring nearly a year.

Mmmm. Kinda makes sense although I can't fathom why Canelo's team were unable to simply allege citizenship accurately and take it straight back to Federal court instead of having to maneuver DAZN into doing it... Took me all of about 5 minutes googling to get DAZNs records at Companies House here in the UK up and find the details of the management company in Delaware they use as their nominal US base.

DAZN has the money to drag this legal battle for years at both local and federal courts. The issue here is who did DAZN signed with: with Oscar that already had a signed contract with Clenelo or did they sign two different contracts with both? If the contract was only with Oscar, Clenelo loses and has to file another suit vs Oscar.

If DAZN had any money they would actually pay the purses they contacted for and not offering stock and other S*** instead of cash like they were with some of their fighters. They are cash strapped and fully expect for them to come to some kind of solution before they even go to court. Fact of the matter is that Alvarez is entitled to the money for the contract, DAZN is the one breaching here, it's better for everyone to cut their losses and move on, even if Canelo doesn't see any more money from DAZN, he's better off just being released so he could sign with someone else and actually start fighting instead of just sitting around and not making any money at all.

Canelo's lawyers are arguing that it's daft to try two related and massively overlapping cases in different courts.
DAZN is incorporated in the UK... this will end in a federal court...

Yes it will, although I was actually mistaken with this post, cos both DAZN and Canelo are now seeking Federal jurisdiction, it's just Canelo's team are seeking to get not just the DAZN case but also the GBP claim tried in the district court and seeking to have it tried under the judge who was originally assigned.

i think it’s a little more complicated than that. no law firm, particularly one as accomplished as canelo’s, is that incompetent lol
