Any fight which place at any weight above 154 and up to 160 is a middleweight title fight and therefore, by definitation, it takes place in the middleweight division and the boxers involved are fighting as middleweights.

you are right, when a title is involved is a whole different story... but when a fighter has no title it can choose the weight even if above his division and organizations wont care...
