I think the samething happened in the mayweather vs pacquiao fight
Some people wait till the last minute to buy a ppv fightComment

Yeah who knows if they have a fine print in all this especially since it seems like a class action lawsuit is launching. But aside from that this just kills the UFC brand and reputation if they don't compensate fans. Boycotts of their ppvs could come next so would you rather just refund folks and regain some goodwill with the public? Or screw fans and loses double and triple this money in lawsuits and revenue from future fights?Comment

I'm a lawyer and can say that the fine print doesn't always save you from all the things included in the fine print. There are certain things you can't disclaim in a contract such as negligence, recklessness, fraud, illegality, etc. This depends on the jurisdiction but rest assured that many contracts include terms in fine print or elsewhere that are not valid (enforceable). They may be enough to trick an average person into thinking they don't have recourse but if litigated in court could very well be held meaningless and even used against them. I lost money in this fight because I paid for the service and was not able to get a single minute of service. If I don't get a refund, I don't care what they say it's in the fine print, I am walking over to the court and personally filing a lawsuit on my own behalf and will fight that thing tooth and nail with my wife (also a lawyer) the same way I have done hundreds of times on behalf of others.
I know it sucks for UFC to have to give back all those refunds but it's extremely unethical to have your individual customers bear the cost of your failure as a company. Plus they would be indemnified in some way by whatever company they use to provide their cloud-based streaming services (highly unlikely that UFC has the IT infrastructure to provide this service and almost certainly pay a cloud provider to host and service their digital content). It was the cloud service provider who breached their service contract with UFC... UFC will likely get some form of compensation from their cloud provider for this failure which would make this doubly eggregious that they would profit for this failure from both ends - customers and their cloud provider... I will boycott UFC and any UFC partner/subsidiary/etc. until they make this right.Comment

Yeah I don't know all the legal rights for this but putting that aside it's just not a good look for the UFC brand and there are so many folks that were robbed and they still ain't put out a statement addressing it. if you sign a contract where you get a payment up front at the expense of your paycheque on the night, you can't complain that you got underpaid, and that's what Nate Diaz did. Conor actually told the UFC to give him 500k to make the fight happen. Nate made bank in reality.
Yet more ignorance from boxing fans who seem to have forgotten how many boxers now have nothing because of the **** stains that ripped them off left right and center. That wasn't Dana White or the UFC, that was the noble people of boxing.Comment

Now it's getting real
Showtime hit with class action lawsuit over failed Mayweather-McGregor streams https://t.co/8XKlbCx5UQ pic.twitter.com/C9Oq0AdmJe
— Hollywood Reporter (@THR) August 28, 2017
"Instead of being upfront with consumers about its new, untested, underpowered service, defendant caused likelihood of confusion and misunderstanding as to the source and quality of the HD video consumers would see on fight night," writes attorney Michael Fuller in the complaint filed late Saturday in Oregon federal court. "Defendant intentionally misrepresented the quality and grade of video consumers would see using its app, and knowingly failed to disclose that its system was defective with respect to the amount of bandwidth available, and that defendant’s service would materially fail to conform to the quality of HD video defendant promised."
The complaint, which is largely composed of screenshots and tweets, is seeking for each member of the class actual damages or $200 in statutory damages, whichever is greater.Last edited by bigdunny1; 08-28-2017, 02:38 PM.Comment
