If it goes to court the judge can go by his own discretion that this was "effectively a marriage" so the same rules would apply as a state marriage registry.

If that was the case cohabitating couples would all have a case when they split. Going by the discretion of the judge is not to the letter of the law which again makes any attempt of a judge passing an Islamic marriage off as a Western state marriage very weak and will be easily countered successfully by any half decent divorce lawyer.

There's a reason the dotted line exists in all contracts including marriage. Once you sign that dotted line it's legally binding. Official.
