No it wouldn't. The 5 million would just be a penalty agreed upon for failing the test. The punitive damages that would incur due to the fight being cancelled would be completely separate. I have worked on these types of litigation many times and know from experience.

No that's not how it works... unless there is more to this agreement than stated in the article, the fine would only be imposed on the failed test for each fighter. Lost revenues from a cancelled fight would be a battle between TMT/TopRank/HBO/Showtime. In no way would the fine have any bearing on how much damage they can sue for. Additionally it would have no bearing on what any boxing commissions can penalize the boxer for.

LOL and you saw what happened to the guy that believed in Karma. BODY BAG. ZIPPED UP. 3-0.

Once this fight is over and Pacquiao is bruised battered and put to sleep. His steroid use will be put all over the net and revealed in a tell all. It's going to cause mass suicide which will help the Carbon Emission levels lower. A win win for society and Earth.

You guys need to go read the ESPN article because this was recent and that YouTube video you showed was from the press conference. Kontz was explaining on ESPN that he wanted to make the 5 million as a part of the contract with the usada testing and Ellerbe still said no. This would have been a completely separate contract. They still could have sued again because pulling out of the fight due to the failed drug test also violates the terms of the fighter contract as well as the usada contract. If you didn't read it this article yet you should because kontz brought up a lot of valid points and Ellerbe had a couple good points too but then he resorted to using playground antics saying "why does pacquiao want the 5 million dollar stipulation? So he can violate it" that's the most ridiculous bullcrap in the world and anyone who believes pacquiao has been worried all these months about possibly failing a drug test are just ******. Hes never failed a drug test before and he never will. Imagine the shame that would be to the entire country of the phillipines which has 200 million people. Manny would probably never be allowed back let alone win another election or have any credibility. Hes never failed one and he never would

"arum only said that to be diplomatic " or when presented with facts "make a separate thread doe"

Your 100% correct. These internet lawyers won't face facts though, they have to defend their hero no matter how dumb it makes them look.

You can file lawsuit for almost anything there is nothing that can prevent any one from suing but it will significantly weaken any legal recourse if there is an out clause

Yes it's more to it which is what arum stated in video that's posted in thread agreeing to that clause will limit what you can sue for which is way more then the 5mil you can't sue for something you agreed to be payed for for a failed test what are you going sue for if you already got paid 5mil basically

I don't have to debate with you because everyone else is ping pong slapping you around. I guess you are just a glutton for punishment.
who are ping pong slapping me around? ha ha ha ha,

like you, they stopped posting when they realized how genius they were.

Koncz statement very clear Michael Koncz, told the Los Angeles Times that Team Mayweather rejected Manny's request for a $5 million penalty if either boxer comes up positive for a banned substance in a drug test. United States Anti-Doping Agency (USADA) is handling the random drug testing protocol.

did koncz said because Floyd were afraid? did koncz said he is accusing Floyd pf cheating? no just said they want to put money where their mouth is,

they said watch the clip ok i watch the clip and arum said mayweather rejected the 5 million dollar penalty.

if you want to develop and enhance your reading comprehension, go watch youtube clips hahahaha

                    Genius Floyd fans
