Do punches in a clinch count?

Actually its excessive clinching that is illegal not clinching there was a thread on it a while ago but it varys between states/countries and is often at the refs discretion.

the fighters know what's legal and what's not. why can't they be sportsman?

Definitely. In a close round, the guy working in the clinch may win that round because of those punches. Certain fighters do great damage punching in the clinch.
