      • In regards to oral agreements, the court will look to the conduct of the parties. . . Taking a 70k advance is certianly one factor that will be taken into account. . . A pretty damn improtant one that demands a lot of weight.

        However, Gamboa could have some things in his favor as well. . .

        We'll have to hear both sides before we get an idea. .

        I will be sure to keep up with the case, as I have access to WestLaw and Lexis Nexus (and in turn, full court transcripts, discovery, depositions, etc.). . If anybody wants to know, just ask me!

            You do know it is not about the 1.1M? It is however the way is been divided and the whole contract... And if he can't sell a ballroom how come HBO cancel the whole card if he is not there?

            • I am sure that Gamboa will be screwed. You can't do anything now of days without it being caught on tape. I am sure that Top Rank records all their calls and if you go talk to them in person, I have no that you will be on video tape. I wouldn't doubt that in most, if not all cases, then make people sign some sort of a promissory agreement, so they can get the ball rolling until they can get the official fight agreement drawn up.

              • The main issue we should be worried about is not this litigaiton about Top Rank recovering their losses for staging the Rios fight, but whether or not Gamboa can get out from this "two-year extension" THAT is what could prevent him from fighting. . .

                  Boxers do it al the time, Cotto just did it. Of course we don't know the details, and it may be that they're required to sign a 1 fight promotional deal with the promoting company(ies).

                  • If anybody is a real boxing fan, they shouldn't care who promotes Gamboa - AS LONG AS he gets back in the ring ASAP. . . Whether it's under Top Rank, Golden Boy, Mayweather, Arena Box, etc. . .

                    This doesn't really concern me; I'm concerned about whether or not: 1.) TR does indeed have an airtight contract (in which he recernly signed a two year extension), 2.) Arena Box has an airtight contract (for however long the duration is - I've heard 2016), and if they are airtight, 3.) whether or not Gamboa will decide to either jsut suck it up and fight under them until expiration, or 4.) whether or not they will allow him to buy the contracts out, so he can fight under another promotional banner of his choice ASAP.

                      THIS! You hit the nail on the head by discriminating between the two issues. . . If this was just a "fight agreement", it's not a big deal. . Worst case scenario for Gamboa he gets popped with the fees, and has to pay TR and Arena back. . .

                      We need to worry about whether or not this contract extension is legit. . . Cause Gamboa won't be fighting unless they let him buy it out, or release him. Hopefully (if they won't let him buy his contract out), Gamboa will just do like Donaire and make amends with TR to continue his career.
