Going to court to bring a restraining order into effect against someone has nothing to with 1941 Germany, it's more of an American tradition. And claiming the weigh-in slap (which was actually fined with 50,000 $) is Boente's fault without backing it up with any evidence surely doesn't fall under "stating your opinion", it's speculative accusation.

Saying "I think" is ridiculous, otherwise the whole body of law is useless as you can simply prefix every potentially defamatory statement with "I think". You wouldn't like it if someone said you engaged in prohibited activities with children but simply said "I think" before it making it legal.

If you back an opinion up its no longer an opinion, its a fact. Me personally, I could give two ****s what anyone says. If you haven't done anything wrong that all that needs to be said. You know why? Because people with no proof are only looking for a reaction. Nobody has taken Huck seriously about this. By filing a restraining order though it not only gives the appearance of (not in my mind) wrong doing, but it keeps Huck's name relevant which is what he wants.

Just summarizes my point perfectly. IMO the lawsuit wasn't necessary, as no one takes frikkin' Huck seriously anyway, but if Boente thinks it damages his reputation when he has done nothing wrong, then he has the right to go to court.
