"Moving defendants argue that Pacquiao has failed to sufficiently allege malice because moving defendants could not have known one way or the other whether Pacquiao had actually taken PEDs when they made the alleged defamatory statements," the order reads. "However, the court finds that Pacquiao has sufficiently pled malice in the amended complaint."

A poster, I forget who it is, had access to actual legal files (think he's a law student) and posted the actual amended complaint with the judges notes on it. Basically all of Manny's assertions were backed up by the court- he proved slander/libel, malice, etc. Basically, the case is won and Floyd knows that (like DLH and Schaefer came to realize) but he's just making his situation worse by ducking the deposition, at least Oscar and Richie Rich had the balls to take the stand.
    I think it was Medved

Civil suits hardly ever get thrown out of court. Even though this one should have been. And alleging defamation is a far cry from proving it. If he had already proven it why would there even be a need for Mayweather to be deposed or go forward with a trial?

            • And Richard Schaefer and Oscar De la Hoya settled the case with Pacquiao out of court. They never took the stand. I don't see the connection between taking the stand and having "balls". A fighter filing a lawsuit against another fighter because of something he said when he could fight him instead doesn't seem like a very ballsy or manly move IMHO.

What did I tell you before? Study up, then post...
"Oscar De La Hoya's deposition was taken, and Richard Schaefer's deposition was taken limited to the motions that they filed," said Petrocelli, who gained a wrongful death civil conviction against O.J. Simpson in 1997.

"Their testimony was presented to the court in relative part and in relation to the motions that are in front of the judge right now," said Petrocelli. "We think that it will go to trial, but given how the process works, it won't be anytime this year, but probably sometime next year. There is no schedule set."

And after that they, for whatever reason, decided to settle out of court and bend the knee in apology. Seems kind of odd for a bull**** case that will never go to trial, no?
