Floyd is ducking his deposition as he does all things Pacquiao, and Petrocelli (Manny's attorney) has applied for a judgment in default, which he should get seeing as how Floyd disregarded a court order to show up. Also, the judge who oversaw the case has made it CLEAR that Pacquiao has proven slander/libel and malicious intent:
A poster, I forget who it is, had access to actual legal files (think he's a law student) and posted the actual amended complaint with the judges notes on it. Basically all of Manny's assertions were backed up by the court- he proved slander/libel, malice, etc. Basically, the case is won and Floyd knows that (like DLH and Schaefer came to realize) but he's just making his situation worse by ducking the deposition, at least Oscar and Richie Rich had the balls to take the stand.
"Moving defendants argue that Pacquiao has failed to sufficiently allege malice because moving defendants could not have known one way or the other whether Pacquiao had actually taken PEDs when they made the alleged defamatory statements," the order reads. "However, the court finds that Pacquiao has sufficiently pled malice in the amended complaint."
