Then the jury figures that just to be fair and not let off a potential baterer they can go non-guilty on everything but that one charge (usually the defendant has already admitted to yelling or throwing stuff). The 4th degree assault has a max sentence of 1 year and the judge doesn't like when people take DV cases to trial so they punish the defendant who beats all the heavy stuff with a max sentence or half the max on a 4th degree misdemeanor. It happens every day.

    You can see a similar pattern with FM's case. They are throwing heavy stuff at him that probably wont stick but its just to set up a misdemeanor assault which could. In some states you are better off like Chris Brown and beating a woman up and pleading then going to trial innocent in search for justice.

            Like I said one other time.....

            In my country, I was once a bit of a jack-the-lad, and am now a well-respected contributing member of society. Had I lived in the states, I would be a hardened criminal, and would most likely still be serving time for "mistakes" that I made in my youth.
