Dont be surprised if FM does as much as 8 months in jail. Some states are really crazy with their DV laws. I don't know about Nevada but in Washington its a damn shame.
I've seen people take a DV assault to trial and lose without the victim even being present. The victim could even write a statement saying that everything was trumped out of spite and the prosecutor will argue that they were coerced to write it. Then what the county prosecutors do is they throw a 4th degree assault on top of heavier charges. They can argue that 4th degree assault is anything physical even yelling because it might cause someone to shake in fear and fear is physical. Then the jury figures that just to be fair and not let off a potential baterer they can go non-guilty on everything but that one charge (usually the defendant has already admitted to yelling or throwing stuff). The 4th degree assault has a max sentence of 1 year and the judge doesn't like when people take DV cases to trial so they punish the defendant who beats all the heavy stuff with a max sentence or half the max on a 4th degree misdemeanor. It happens every day.
You can see a similar pattern with FM's case. They are throwing heavy stuff at him that probably wont stick but its just to set up a misdemeanor assault which could. In some states you are better off like Chris Brown and beating a woman up and pleading then going to trial innocent in search for justice.
