Now from what I've heard in most courts the questions that they ask the child are mostly in the mothers favor so even if she is lying..Floyd may want to take a page out of Kobe's book and just pay the chick, on the flip side he has proof that she has made stuff up in the pass, so if she is telling the truth now he still could get away with it...in the long run who cares, just hope he is hitting someone in the ring soon

I'm not sure if that will work here. They've taken the testimony from Josie and Floyd's son and this is a criminal case, not a civil one. I'm not an expert but I believe the state can proceed with a criminal charge now without her.

Any legal experts in here that can clarify this?

The State will press charges, but they have to prove their point. They will do so with Josie's testimony and her son's. If Josie has made stuff up in the past, her credibility is not as good. As for the son, I don't know how old he is, but if he is 7-8 or older, he understands that he must not lie, he can testify. In any case, the reliability of a witness will be appreciated by the judge.

I am Canadian, but I guess it works similarly in the USA...
