It hasn't gone through yet. The Lawyer was guessing and assuming. Nothing has happened yet. Not officially. He said he "thinks" it will go to trial. Not it "will" go to trial next year. What else would he say when he's getting paid?

What they don't know is that both Oscar and Schaefer were forced to give sworn depositions to a jury and they were reportedly roasted by Petrocelli, which is why the judge overhearing the depositions decided to let it go to trial. And Pacquiao is seeking $5 million+ in damages, $75K was the minimum needed to file a defamation suit.
