Random testing is the best way to test an athlete. It doesn't matter if the athlete isn't on steroid, but they cannot give specific dates of when he/she should take the test, it's like asking a teacher what the questions are gonna be on an open book test. Yes Pacquiao has agreed to take the test, but he has no right to ask when he should be tested, leave that to the agency to decide. They're not doing Floyd's side any favors because he won't be able to choose when he should be tested as well, the agency decide when both fighters should be tested. Obviously, i can understand Manny Pacquiao side of not taking the test right before the fight because he believe it would weaken him, but he must understand that it would only help the sport of boxing and keep the fight clean and even.

The only thing that makes you seem questionable, at least to me, is the malice standard you stated. The term used in a defamation case is "actual malice", not "malice aforethought", a phrase used to describe the mental state of a person commiting crimes. It may have been a innocent mistake, since they are similar. Also, I think you mentioned the burden of proof is on the defendant....The burden in a civil case is always on the plaintiff. Although it is true that in some civil cases the burden does shift after the plaintiff makes a preliminary showing; however, this is not the case for any of the defamation torts. Other than that you are pretty much right- Pacquiao's case will most likely not survive a 12(b) motion or its equivalent.Comment
