That's a different scenario. As far as we know, Margarito didn't think about not using the wraps. He was caught before he could use it, that's the difference. We see no sympathy in this situation.

True story. Shane isn't completely innocent, but his situation is more excusable because Margarito could seriously hurt people with those wraps.

It's not that Shane's offence is excusable, it isn't - but it's a far more minor offence. Shane should still be fined. But Marg should be banned for life.
