He has lost only 6 times with 1 draw so I don't think his age should disqualify
him from competition. If a commission wants to see a workout that included sparring I think that's reasonable. If he is passing his complete physicals with high marks he should be granted his papers!

EU law prevents a legal BBBC monopoly over sanctioned fights in the UK. Briggs can get any EU commission sanction to fight in the UK.
David Haye fought with a Luxembourg commission licence against Chisora, and the BBBC could not do a thing about it.
