Would you fire a gun at an unarmed man? Regarding sucker punch

In the recent Floyd Ortiz fight. We saw Floyd sucker punch Ortiz after the hug. You can see that Ortiz hands are down and his feet all squared up while backing up. without even any leverage to throw a punch if he tried. He hasn't reset to be in a fighting stance to box with Floyd. So my question is, would you fire a gun to a guy not prepared to fire a gun in a cowboy shooting draw? (analogy: Victor was the man whose far from his gun, his hands were down and clearly not in fighting stance to throw a decent punch. Remember he was all squared up.) When there is a shooting draw. both gun slingers hands are near the gun before they draw. In this case Ortiz hands wasn't ready to fire a gun his hands were no where near the holster. So the question is Will you fire a gun at a guy whose hands are not close to a holster in a shooting draw?Your hands are near the holster before you fire a gun. A gunslinger hands are near the gun before they fire. But as you guys know victors hands were nowhere near the gun.. Would you fire knowing the other gunslinger isn't even in a fighting stance and is still not ready to fire?
