To date, I haven't seen anyone from the Ortiz, Mosley or Mayweather camps express any concern about failing or "missing" a drug test.
Why does Team Pacquiao keep voicing concerns over failed or missed tests?
As part of his contract, Mayweather insisted Ortiz agree to a more stringent drug-testing procedure than the random urine tests required by the Nevada State Athletic Commission. The U.S. Anti-Doping Agency is performing random blood tests on Mayweather and Ortiz, as it did in Mayweather's most recent fight in May 2010, against Shane Mosley.
Bob Arum, Pacquiao's promoter, says his fighter is willing to accept being subjected to blood testing rules under the World Anti-Doping Agency code, which keeps the blood sample schedule unannounced. Pacquiao had previously said he didn't want to be tested within 14 days of a fight.
"You can't have a window where an athlete knows he'll not be tested," said Travis Tygart, head of the USADA. "Unannounced testing is part of the deterrent."
Arum said the tricky part of a testing program will be in establishing consequences for events like a missed test, or for a banned prescription drug that is prohibited in the Olympics.Arum wants a state boxing commission, like Nevada's, to have a say in establishing such guidelines to avoid an unreasonable fight cancellation.
So perhaps the super-fight fans want to see is on track for 2012 — assuming Mayweather and Pacquaio win their next bouts.
Asked if he'll take the fight as long as Pacquiao cooperates in an effective drug-testing program, Mayweather said, "Absolutely. Write that word down 10 times in a row. I absolutely want the fight."

I spoke today with a representative from the FDA via their Drug Information line. I asked them if Xylocaine was illegal or banned in this country. The representative said there are no bans on this drug. The representative also said that there would be no reason for individual states to make this drug illegal especially if its FDA approved. However, if this drug is administered by an I.V. or through injections then it must be done under the direct supervision of a licensed medical professional.

When I called them yesterday, I spoke directly with their telephone doctor of the day. First, I must say that it was very informative being able to talk to a USADA doctor about this drug and the potential side effects. Anyhow, the doctor said that Xylocaine is legal for boxers to take via injection into the hands. He also said that individual state athletic commissions might have additional stipulations.

In a conversation that I had with Keith Kizer, about the use of Xylocaine in the state of Nevada, Keith said that because “It is not a prohibited substance under WADA or USADA”; it’s not banned by the State Athletic Commission. However, Keith Kizer noted that the commission has added some stipulations to the use of Xylocaine.
“We don’t want fighters to use it on fight day. We make sure they have full physicals to check for this. They will be told to stop doing this from the weigh-in through the fight. Fighters must only take Tylenol or ice for any pain.”

Conclusion
As of February 17th 2010, Xylocaine is not banned according to the FDA, USADA, WADA, and the NSAC. In fact, I can’t find any other State Athletic Commission that bans it either. So, Floyd Mayweather’s use of this drug for his hands is not illegal. And, as long as he doesn’t use it from the weigh-in through fight day, then he won’t get into any trouble. However, this doesn’t mean that this drug is still safe or something that the general public should just go out and acquire.
Xylocaine, in most methods of usage, needs to be supervised by a licensed medical professional due to potential serious side effects like an abnormal heartbeat. In addition to potential side effects, there are also some long-term effects like dementia that could be experienced.
Regardless of the side effects and the legal use of this drug, it still remains debated whether this drug gives Floyd an advantage or not. It’s clear that there would be an advantage on fight day if he couldn’t experience any pain in his brittle hands but is this drug a real advantage during training?

According to The Mayo Clinic – “Performance-enhancing drugs and supplements are used to boost athletic performance, ward off fatigue and enhance physical appearance. They're also taken to increase muscle mass and strength.”
Xylocaine might be legal but it remains highly controversial. Does the legal allowance of this drug override the performance enhancements that this drug provides?
Although, I think this drug is controversial and a PED, the very fact that it's still legal, according to those who I spoke with, makes me wrong for previously thinking it was illegal. I was misinformed, like a lot of people, when we were told that this drug was illegal. I was wrong, and unlike Floyd Mayweather, I'm not afraid to admit when I'm wrong. If I'm going to hold others accountable then I have to hold myself accountable too. However, If anyone has any other evidence that this drug is banned in "49" states, then please contact me so I can verify it and check with the proper authorities.

It's a valid question, from a business standpoint.
This is a 9 figure profit business transaction, will Floyd still fight Pac if he turns out dirty?
All Floyd said is that he wants Manny to take OST... He didn't say what he'll do if he fails.
That is a good question many are not asking. If Manny does fail the test and Floyd decides to make the fight happen anyway, the point Floyd has been trying to make will have been proven.
"Will Manny (Or his handlers allow him to) fight if he fails the test?" is the other question. That is highly doubtful. Manny will suffer much humiliation after having been praised by the boxing public and the media for so long.

So if the regular Nevada testing hasn't caught floyd yet, MAYBE THE current testing isn't good enough! Since they can't catch floyd cheating with xylovcaine, maybe they should start random test with no cutoff because to catch him.

But because he is refusing taking an enhanced testing procedure that he and his opponent would both take, its not suspicious. Personally and with all honesty, I'm not sure nor do I openly accuse that Pacquiao is on PEDs but goddamn they're making it hard to believe Pacquiao is clean. I like Pacquiao I think he's a great athlete and his rise has been tremendously entertaining but would I be surprised if Pacquiao is caught using any PED? Absolutely not.
I mean no one in the world has so much pride that they wouldn't agree to a completely random testing procedure that they would jeopardize losing 50 million dollars! It's insane. If you're clean and you know it you take the damn test and beat the crap out of your opponent for trying to make you look bad. You don't try to go around trying to create some loopholes.
