Retired boxer Oscar de la Hoya, owner of Golden Boy Promotions, and his promotions company's chief executive Richard Schaefer, have filed in court last week a motion to dismiss the defamation lawsuit filed by Manny Pacquiao against them.
Golden Boy Promotions executives led by Oscar de la Hoya and Richard Schaefer have filed a motion to dismiss the case filed by Filipino boxer Manny Pacquiao against them for defamation.
The defamation case was filed by Pacquiao's lawyer Dan Petrocelli after Floyd Mayweather,Jr, his father Floyd, Sr, Roger Mayweather, and the Golden Boy executives accused Manny Pacquiao of taking steroids or performance enhancing drugs to gain advantage over his opponents during his previous fights.
Pacquiaio denied the charges, saying he passed all drug tests by the Nevada Sports Athletic Commission (NSAC)
Oscar de la Hoya and Richard Schaefer defended their statements on Manny Pacquiao’s alleged steroids use, saying that their comments were “opinions and reasonable questions.”
Pacquiao's lawyer amended the lawsuit last month and included additional defamatory statements by Floyd' Jr's uncle Roger Mayweather. The complaint as amended, seeks damages in excess of $5,000,000.
In the meantime Schaefer has hired Judd Burstein a former lawyer of Pacquiao who represented the Filipino boxer in his case against former promoter Murad Muhammad in 2005. The allegations by the Mayweather camp that led to the defamation case by Pacquiao have caused the cancellation of the Pacquiao-Mayweather fight originally scheduled for March 13. The cancellation of the fight was further fueled by Mayweather's demand for Olympic-style drug testing protocol which was rejected by the Pacquiao camp.
Following the cancellation, Top Rank's Bob Arum proceeded with the March 13 schedule with Joshua Clottey as Mayweather's replacement. The fight which drew more than 50,000 people to watch the event was held at the Dallas Cowboys Stadium in Arlington, Texas. Pacquiao won the fight via a 12-round unanimous decision.
Meanwhile, Mayweather has agreed to face Shane Mosley on May 1 at the MGM Grand Garden in Las Vegas, Nevada.
Both camps maintain that the highly-anticipated Pacquiao-Mayweather match will eventually happen.

Mosley) was given a pass on drug testing (which he was willing to take, to his credit) but the company went to bat for him and said he didn't have to be treated like a cheater, but for you, YOU have to take the test, how would you feel? Is that on you? Why was it different for Mosley.
No one, and I mean NO ONE, should have to submit to drug tests they are not required to take.

but this is not a work requirement...it's an independently drawn contract managed by a promotion company...completely different... and GBP may request if they fell it put their other fighters in the line of danger...it was always at pac's discretion to take the test...he didn't want to agree to the contract...that's on him...
if your job comes to you and tells you they have a new position that requires a physical...and you've never taken a physical for any of your other positions...it's on you to accept the terms...if you don't...that's on you...it's going to be on pac to prove that he has suffered financially due to the scrutiny that he's claiming GBP is backing on account of mayweather...but if GBP is looking out for the best interest of both fighters...what if floyd and manny faught...floyd get's hurt...then it comes out that manny was on something...floyd could have the right to sue...so in the best interest of both fighters, GBP would be a fool to deny conveying floyd's request...especially after he's made it public...

Wrong. Your employee handbook would have random tests specifically outlined, and that would have to be clearly addressed to all new employees during orientation or it's a clusterfock nightmare for HR if they did change the rules on you.

No this is not elementary school, this is real life and boxing at highest level where millions of dollars are potentially at stake. Manny Pacquiao's own (minority) promotor who willingly makes a profit off him, has gone on record that they won't entertain matching Pac against other fighters in their own stable unless he submits to drug testing that he is under NO obligatation to take. What kind of promotor canibalizes it's own fighter, and does not serve his best interest?

But if Pacquiao attempts to deal with JMM for a third fight, and Golden Boy sticks with that hard line stance that he must submit to blood testing that is not recognized by any of the boxing commissions, then he can potentially lose the purse of that fight that would have been made if they signed a regular boxing contract under current rules. They made 2 fights before with no OST, why now? Estimates can be drawn for a hard dollar figure that can be used in court, and could be argued with some validity based on past PPVs. Goldenboy specifically targeting one of it's own fighters can be construed as defaming one of it's own. How far it goes, I don't know, but don't tell me this is nothing. Pacquiao can easily come up with dollar amounts for fights that can be made if GBP refuses to negotiate on his behalf...a fighter, mind you, that supoposedly is part of their stable.
I understand what your saying but I don't recall any GBP representative specifically saying Pacquiao does steroids. Just because they say it's odd that he wouldn't take a blood test or how is he afraid of needles but has tattoos all over, doesn't mean they are throwing him under the bus. It's their opinion and reasonable questioning. It's not like they froze him out or forced him into taking drug tests that aren't in the norm. So where does Pacquiao come off sueing GBP? He has no grounds to sue them.
The only person(s) who specifically stated that Pacquiao is on PEDs is Roger and Sr. Who both of which accused Pacquiao of being on a made up, mythical, non-existant drug. Floyd indirectly accused him of steroids but never specifically said Pacquiao's name nor specifically stated any drug.
So again, in my opinion, Pacquiao lawsuit falls way short of being taken seriously in court. I think it will be thrown out, if Pacquiao doesn't drop the charges before it goes to court.
